Terms of service

Terms of Service

Overview

This website is operated by Pyefinch Crafted Gifts. Throughout the site, the terms “we”, “us” and “our” refer to Pyefinch Crafted Gifts.

These Terms of Service set out the terms on which you may use our website and purchase products from us. By placing an order through our website, you agree to these terms.

Nothing in these Terms of Service affects your statutory rights as a consumer.

1. About Us

Pyefinch Crafted Gifts is the trading name of Keith Pyefinch, a sole trader based in the United Kingdom, creating and selling handcrafted gifts, homewares and accessories.

You can contact us at:

Email: hello@pyefinchcraftedgifts.co.uk

Our geographical business address and further contact information are available on our Contact Information page.

2. Our Products

We make every reasonable effort to describe and photograph our products accurately.

Many of our products are handmade and/or made from natural materials such as solid timber. Natural variations in grain, colour, figure, texture and other characteristics are to be expected and mean that individual products may differ slightly from photographs shown on our website.

Similarly, handmade products may have small variations between individual pieces as a natural result of the making process.

These variations form part of the individual character of handmade and natural-material products and are not considered faults where the product otherwise conforms to its description.

Product dimensions are stated as accurately as reasonably possible. Minor variations may occur in handmade products.

3. Prices

All prices displayed on our website are in pounds sterling (£).

The price payable for a product is the price displayed when you place your order, together with any applicable delivery charges shown during checkout.

We reserve the right to change our prices at any time, but changes will not affect orders that we have already accepted.

If we discover an obvious pricing or listing error after you place an order, we will contact you as soon as reasonably possible and give you the option of proceeding at the correct price or cancelling the affected item for a full refund.

4. Placing an Order

When you place an order through our website, you are making an offer to purchase the products in your order.

You are responsible for checking that the information you provide, including product selections, personalisation details and delivery information, is accurate before submitting your order.

After placing an order, you will receive an electronic confirmation. Your order is accepted when we confirm that we have accepted or are processing your order for fulfilment.

We reserve the right to decline or cancel an order where reasonably necessary, for example where a product is unavailable, an obvious pricing or listing error has occurred, payment cannot be authorised, we reasonably suspect fraudulent activity, or we are unable lawfully to fulfil the order.

If we cancel an order after payment has been taken, we will refund the amount paid for the affected products and any applicable delivery charge.

5. Payment

Payment must be made using one of the payment methods offered at checkout.

You agree to provide current, complete and accurate payment and order information.

Payment services may be provided by third-party payment providers and may be subject to their own terms and privacy policies.

6. Delivery

Available delivery methods, charges and estimated delivery times are shown on our website or during checkout.

We aim to dispatch orders within the times indicated on our website. Where an item is handmade or made to order, additional preparation time may apply where this has been stated on the product page or otherwise communicated to you.

Delivery estimates are estimates rather than guaranteed delivery dates unless we have expressly agreed otherwise.

We will deliver goods without undue delay and, unless another period has been agreed with you, within the period required by applicable UK consumer law.

Please ensure that the delivery address supplied with your order is complete and accurate.

Further information can be found in our Shipping Policy.

7. Personalised and Custom-Made Products

Some products may be personalised or made to a customer's individual specifications.

You are responsible for checking all names, wording, dates, dimensions or other personalisation information before submitting your order.

Where possible, please contact us promptly if you discover an error after ordering. If work has not yet begun, we will make reasonable efforts to accommodate a requested change.

Products that are made to your specifications or clearly personalised may be excluded from the statutory right to cancel for a change of mind. This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise do not conform to the contract.

Please see our Returns & Refunds Policy for further information.

8. Returns, Cancellations and Refunds

Your rights to cancel an online order, return unwanted goods and obtain refunds are explained in our Returns & Refunds Policy.

Nothing in these Terms of Service or our Returns & Refunds Policy limits or excludes rights you have under applicable UK consumer law.

9. Faulty or Misdescribed Goods

Products supplied by us must be as described, of satisfactory quality and fit for their intended purpose as required by applicable consumer law.

If you believe an item is faulty, damaged, incorrect or not as described, please contact us at hello@pyefinchcraftedgifts.co.uk so that we can investigate and put things right.

Nothing in these terms excludes or limits your statutory rights.

10. Product Care and Use

Where product care or usage instructions are provided, please follow them to help maintain the condition and safe use of your product.

Products should only be used for their intended purpose.

Information about caring for our wooden products is available in our Product Care Guide.

11. Age-Restricted Products

Certain products may only lawfully be sold to customers who meet a minimum age requirement.

Where an age restriction applies, you must meet the applicable minimum legal age to purchase that product. We may use age-verification measures and may refuse or cancel an order where we cannot satisfactorily verify eligibility to purchase an age-restricted product.

Age verification may also be required upon delivery where appropriate or legally required.

12. Website Information and Availability

We aim to keep the information on our website accurate and up to date. However, occasional errors or omissions may occur.

We may update product information, prices, photographs, availability and other website content where reasonably necessary.

We do not guarantee that every product will remain available at all times. If a product becomes unavailable after you have ordered it, we will contact you and provide an appropriate refund where we cannot fulfil the order.

13. Intellectual Property

Unless otherwise stated, the content of this website, including our original text, photographs, graphics, branding and product imagery, belongs to Pyefinch Crafted Gifts or is used with appropriate permission.

You may view and use the website for your personal, non-commercial use.

You must not reproduce, republish, distribute or commercially exploit our website content without our prior permission, except where permitted by law.

14. Third-Party Services and Links

Our website may use or link to third-party services, including payment providers, delivery services and other websites.

We are not responsible for the content or availability of third-party websites that we do not control.

Use of third-party services may also be subject to the terms and policies of the relevant provider.

15. Liability

Nothing in these Terms of Service excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability that cannot lawfully be excluded under consumer law.

We are responsible for losses that are a foreseeable result of our breach of these terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Where you purchase products as a consumer, we do not exclude or limit any liability or remedy that cannot lawfully be excluded or limited.

16. Privacy

Your personal information is handled in accordance with our Privacy Policy.

Our website may also use cookies and similar technologies as explained in our Cookie Policy.

17. Changes to These Terms

We may update these Terms of Service from time to time, for example to reflect changes to our business, website or applicable law.

The terms applying to an order will normally be those in force when the order is placed.

18. Governing Law

These Terms of Service and contracts for purchases made through our website are governed by the applicable laws of the United Kingdom.

If you are a consumer, you retain the benefit of any mandatory protections and rights provided by the law applicable to you.
